ACCEPTANCE OF TERMS

By requesting, authorising, booking, accepting or receiving services from A GAS BLOKE Plumbing Services, or by receiving an invoice, quotation or written confirmation from us, the customer agrees to these Terms & Conditions of Service.


These terms apply unless alternative written arrangements have been approved by A GAS BLOKE Plumbing Services before the work proceeds.


BUSINESS DETAILS


A GAS BLOKE Plumbing Services provides gas fitting, plumbing-related services, site works and related trade services across Maryborough, Hervey Bay, the Fraser Coast and nearby areas.

PAYMENT TERMS


Payment is due upon receipt of invoice unless alternative payment arrangements have been approved in writing by A GAS BLOKE Plumbing Services.

A strict seven (7) day payment period applies from the invoice date.


Partial payments do not constitute acceptance of any reduced amount unless the reduction has been approved in writing by A GAS BLOKE Plumbing Services.


LATE PAYMENT


Accounts remaining unpaid after seven (7) days from the invoice date will incur an overdue account charge of 15% of the outstanding balance plus GST, where permitted by law.


Further overdue account charges of 15% of the then outstanding balance plus GST may be applied at seven (7) day intervals until the account is paid in full, where permitted by law.


The customer is liable for reasonable costs incurred in recovering unpaid amounts, including debt collection costs, legal costs, court costs, administrative costs and recovery expenses.


TITLE TO GOODS AND MATERIALS


All materials and goods supplied by A GAS BLOKE Plumbing Services remain the property of A GAS BLOKE Plumbing Services until payment is received in full, to the extent permitted by law.


The customer must not remove, sell, alter, dispose of or interfere with unpaid materials or goods supplied by A GAS BLOKE Plumbing Services.


QUOTES, ESTIMATES AND PRICING


Quotes, estimates and pricing are based on the information available at the time and any visible site conditions.


Unless expressly stated otherwise in writing, quotes and estimates may change where concealed conditions, existing defects, access issues, incorrect information, additional work, safety issues, compliance requirements or customer-requested changes are identified.


A GAS BLOKE Plumbing Services may charge for labour, travel, materials, parts, fittings, equipment, administrative time, inspections, reports, call-outs and other work reasonably required to complete or progress the job.


ON-SITE INSPECTION AND NO PHONE DIAGNOSIS


Gas, plumbing, appliance, site works and safety-related issues generally require on-site inspection, testing and verification.


A GAS BLOKE Plumbing Services does not provide final diagnosis, confirmed scope, compliance decisions or fixed repair outcomes by phone, text message, email or photos alone.


Any general comments provided before attending site are preliminary only and are not a confirmed diagnosis or final scope of works.


VARIATIONS AND ADDITIONAL WORK


Any work outside the original agreed scope may be treated as a variation or additional work and may be charged in addition to the original quoted or estimated amount.


Variations may arise from concealed conditions, existing defects, compliance issues, unsafe conditions, additional customer requests, unavailable parts, access issues or work required to complete the job properly.


Variations may be approved verbally, by text message, by email, in writing or by the customer allowing the additional work to proceed.


CANCELLATIONS, ACCESS ISSUES AND ABORTIVE CALL-OUTS


If a booking is cancelled, access is denied, the work cannot proceed, required information has not been provided, the customer is not available, or site conditions prevent the work from proceeding, the agreed call-out, consultation, inspection, travel or attendance fee remains payable.


Additional time, travel or return visits caused by access issues, customer delay, unsafe conditions, missing information or site restrictions may be chargeable.


PROPERTY DAMAGE, ACCESS AND EXISTING CONDITIONS


The customer must provide safe, reasonable and suitable access to the work area and must advise A GAS BLOKE Plumbing Services of any known underground services, concealed pipework, electrical cables, irrigation, septic systems, fragile surfaces, restricted access areas, site hazards or other conditions that may affect the work.


A GAS BLOKE Plumbing Services will take reasonable care when carrying out work. However, the customer acknowledges that some work may involve excavation, access through existing structures, movement of equipment, removal of fittings, exposure of concealed services, or work around aged, brittle, damaged, non-compliant or deteriorated materials.


A GAS BLOKE Plumbing Services is not responsible for damage, failure, deterioration, delay or additional work caused by pre-existing conditions, concealed defects, incorrect or incomplete information supplied by the customer, unknown underground services, unsafe or unsuitable access, fragile surfaces, customer-supplied materials, or issues that could not reasonably be identified before the work commenced.


Nothing in these Terms excludes, restricts or modifies any rights, guarantees or remedies that cannot be excluded under Australian Consumer Law or other applicable law.


CUSTOMER-SUPPLIED MATERIALS, APPLIANCES AND EQUIPMENT


Where the customer supplies appliances, parts, fittings, materials or equipment, the customer is responsible for ensuring they are suitable, available, complete, undamaged, compliant and approved for the intended use.


A GAS BLOKE Plumbing Services may refuse to install, connect, repair or use customer-supplied materials, appliances or equipment if they are unsuitable, incomplete, unsafe, damaged, non-compliant, incorrectly specified, missing required components or not approved for the intended installation.

A GAS BLOKE Plumbing Services is not responsible for faults, delays, failures, incompatibility or additional costs arising from customer-supplied materials, appliances or equipment.


EXISTING INSTALLATIONS AND PRE-EXISTING FAULTS


A GAS BLOKE Plumbing Services is not responsible for pre-existing faults, non-compliant work, unsafe installations, poor previous workmanship, concealed damage, aged materials, deteriorated pipework, appliance failure, existing leaks or defects that were present before our work commenced.


If pre-existing defects or safety issues are identified, additional work may be required before the original job can proceed.


SAFETY AND COMPLIANCE


A GAS BLOKE Plumbing Services may suspend, delay, refuse or stop work if site conditions, appliances, materials, access, weather, customer conduct, existing installations or surrounding conditions are unsafe, unsuitable, non-compliant or present a risk to persons, property or the work being performed.


Time spent identifying, isolating, making safe, documenting or responding to safety or compliance issues may be chargeable.


WARRANTY, WORKMANSHIP AND CONSUMER GUARANTEES


A GAS BLOKE Plumbing Services performs work with reasonable care and skill and in accordance with applicable Queensland requirements.


Warranty does not apply to misuse, customer interference, third-party repairs, unauthorised alterations, customer-supplied materials, pre-existing faults, existing non-compliance, concealed defects, lack of maintenance, appliance failure, damage caused by others, or conditions outside the control of A GAS BLOKE Plumbing Services.


Nothing in these Terms excludes, restricts or modifies any consumer guarantees, rights or remedies that cannot be excluded under Australian Consumer Law or other applicable law.


CALL-BACKS AND FAULT REPORTING


Any alleged defect, fault, issue or concern must be reported to A GAS BLOKE Plumbing Services as soon as reasonably possible, preferably within forty-eight (48) hours of the customer becoming aware of the issue.


Call-backs caused by misuse, access issues, customer actions, customer-supplied materials, third-party interference, pre-existing faults, unrelated faults, appliance failure or issues outside the work performed by A GAS BLOKE Plumbing Services may be chargeable.


COMPLIANCE DOCUMENTATION, CERTIFICATES AND REPORTS


Where compliance documentation, certificates, notices, reports or records are required by law or are applicable to the work performed, A GAS BLOKE Plumbing Services will issue or lodge the required documentation in accordance with applicable Queensland requirements.


Additional copies, administrative handling, report preparation, non-standard documentation requests or re-issue requests may be chargeable where permitted.

Nothing in these Terms allows A GAS BLOKE Plumbing Services to avoid any legal obligation to issue, lodge or provide required compliance documentation.


LIMITATION OF LIABILITY


To the extent permitted by law, A GAS BLOKE Plumbing Services is not liable for indirect, consequential or incidental loss, including loss of profit, loss of business, loss of use, loss of opportunity, inconvenience, delay, spoilage, accommodation costs, business interruption or loss arising from pre-existing conditions, concealed defects, customer delay, third-party actions or matters outside our reasonable control.


Nothing in these Terms excludes, restricts or modifies liability that cannot be excluded under Australian Consumer Law or other applicable law.


DISPUTES AND INVOICE QUERIES


Any dispute or query regarding an invoice, charge, scope of work or service outcome must be raised in writing within seven (7) days of the invoice date or completion of the relevant work, whichever occurs first.


The customer must identify the disputed item clearly and provide reasons for the dispute.


Raising a dispute does not remove the obligation to pay any undisputed amount by the due date.


DEBT RECOVERY


If an account remains unpaid, A GAS BLOKE Plumbing Services may take reasonable steps to recover the debt, including issuing reminders, sending a letter of demand, referring the matter to debt collection, seeking legal advice or commencing recovery action.


The customer is liable for reasonable recovery costs where permitted by law.


GOVERNING LAW


These Terms & Conditions are governed by the laws of Queensland, Australia.


CHANGES TO TERMS


A GAS BLOKE Plumbing Services may update these Terms & Conditions from time to time. The version published on the website or provided to the customer at the time of booking, quotation, invoice or service applies unless otherwise agreed in writing.


ENTIRE AGREEMENT


These Terms & Conditions, together with any written quotation, invoice, booking confirmation, scope of works or written agreement issued by A GAS BLOKE Plumbing Services, form the agreement between the parties and override any prior representations unless expressly agreed in writing.
